End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Frametools ("Company"), operated by Kevin Schwed, for the use of Globe Studio ("the Software").

1. License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable license to install and use the Software for your personal or business use.

2. License Scope

Your license key entitles you to use the Software on up to two (2) devices that you own or control, for both personal and commercial purposes, including professional work, client projects, and business operations.

The license covers the current major version of the Software (e.g., version 1.x). You will receive all updates within that major version at no additional cost. Future major versions (e.g., version 2.0) may require a separate license purchase.

3. Restrictions

You may NOT:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, or lend the Software to third parties
  • Use the Software to develop competing products
  • Remove or alter any proprietary notices or labels
  • Use the Software in any unlawful manner

4. Updates and Versioning

Your license entitles you to all updates within the major version you purchased (e.g., all 1.x releases). There is no guarantee of a specific update frequency or timeline. Updates are provided at the sole discretion of the Company.

A new major version (e.g., 2.0) constitutes a new product and may require a separate license purchase. You are never required to upgrade — your licensed version will continue to work indefinitely.

5. Free Version

The Software may be used without a license key in a restricted "Free" mode. In Free mode, exports are limited to 720p resolution and include a visible watermark. Purchasing a license key removes these restrictions for the licensed major version. The Free mode does not expire.

6. Support

Support is provided via email at info@upvis.de. Best-effort support is provided for the current major version. Support for older major versions may be discontinued.

7. Intellectual Property

The Software is protected by copyright and other intellectual property laws. This Agreement does not transfer any ownership rights to you. All rights not expressly granted are reserved by Frametools.

8. Third-Party Software and Data

The Software uses and interacts with third-party components. By using the Software, you acknowledge and agree to the following:

FFmpeg

Video encoding functionality requires FFmpeg, which is downloaded separately by the user and is not bundled with the Software. FFmpeg is licensed under the LGPL or GPL depending on the build configuration. You are responsible for complying with FFmpeg's license terms. For details, see ffmpeg.org/legal.html.

Open-Source Libraries

The Software incorporates open-source libraries licensed under MIT, Zlib, and other permissive licenses. A complete list of third-party components and their licenses is available in the "Third-Party Notices" section within the Software's About panel.

Earth Textures and Geographic Data

The Software includes Earth textures from NASA Visible Earth (used with credit as permitted by NASA's media usage guidelines) and geographic data from Natural Earth (Public Domain). Country border data is sourced from Natural Earth and geocoding is powered by LocationIQ with data from OpenStreetMap contributors (ODbL license).

9. Data Processing

The Software connects to third-party services for geocoding (location search) and update checks. No personal data is stored on our servers. For full details on how your data is processed, please refer to our Privacy Policy at frametools.io/legal/privacy.

10. Geographic Data Disclaimer

Globe visualizations created with the Software are for illustrative purposes only. Country borders, names, and geographic representations displayed by the Software do not constitute political statements or endorsement of any territorial claims. The depiction of boundaries is based on publicly available geographic datasets and may not reflect the most current or universally recognized borders.

11. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Frametools SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

13. Termination

This Agreement is effective until terminated. We may terminate this Agreement immediately if you breach any of its terms. Upon termination, you must cease all use of the Software and destroy all copies.

14. Governing Law

This Agreement shall be governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles.

15. Consumer Rights

Nothing in this Agreement affects your statutory rights as a consumer under applicable EU consumer protection laws. For your right of withdrawal, please refer to our Terms of Service at frametools.io/legal/terms.
